6. This agreement is not assignable by Customer, in whole or in part, voluntarily or involuntarily, including by operation of law or by merger in which Customer does not survive, without the prior written consent of QuickPacket. Any attempted assignment without the written consent of QuickPacket will not be valid.
7. This agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, Iredell County, without regard to choice of law provisions that would cause the application of the law of another jurisdiction.
8. QuickPacket reserves the right to terminate service for any reason with twenty-four hours notice. QuickPacket does not forfeit any rights under this agreement by terminating service. QuickPacket reserves the right to refuse service to anyone at any time for any reason.

17. Customer must submit payment by credit card, PayPal, or other acceptable payment method as determined by QuickPacket by 5:00 PM local time (US Eastern Time) on the due date of the invoice. All fees paid are non-refundable. Please contact us using the support ticketing system if you have any questions about how to make a payment. Service will be interrupted if payment is not received on time. Service interruption does not cancel your service. Until we receive and acknowledge service cancellation, you will continue to be billed your monthly fee. A $35 reactivation fee may be imposed at the discretion of QuickPacket. If the Customer's account becomes past due, interest will accrue on the current account balance at the rate of one and one half percent (1.5%) per month or at the maximum interest rate allowed by law until all account balances are paid.
18. QuickPacket requires written notice of cancellation on all products and services. Dedicated servers and co-location services require 30-days notice of cancellation and all other services require 5-days notice of cancellation. Please use our support ticketing system to notify us of cancellation. Service will not be cancelled until you receive confirmation from us. We only bill in full monthly increments (with the exception of your first month) and we do not offer refunds, so please take this into account when scheduling your cancellation.
19. If any payments are returned as a result of a dispute, insufficient funds or otherwise charged back, QuickPacket will impose a $35 returned payment fee. Service may be interrupted or terminated as a result of a returned payment. If service is interrupted, service will not be restored until the returned payment is repaid in addition to the $35 returned payment fee. If service is terminated, the customer is not entitled to a refund and is prohibited from any further use of QuickPacket services until the $35 returned payment fee is paid.20. QuickPacket makes no guarantee of confidentiality or privacy of any information transmitted through or stored upon QuickPacket technology, and makes no guarantee that any other entity or group of users will be included or excluded from QuickPacket's network. In addition, QuickPacket may periodically monitor transmissions over its network for maintenance, service quality assurance or any other purpose permitted by the Electronic Communications Privacy Act, P.L. No. 99-508, as amended.
21. Customer grants QuickPacket a blanket security interest in the equipment which the Customer has colocated with QuickPacket. In the event of non-payment by Customer, Customer agrees that QuickPacket may sell the Customer's equipment to satisfy the account balance owed to QuickPacket by the Customer. Any amounts collected from any sale of the Customer's equipment above and beyond the balance owed will be returned to the customer within ten (10) business days.
22. In order to protect against fraudulent orders, QuickPacket may request a scanned or faxed copy of the credit card, a government-issued photo identification (such as a passport) and/or a recent utility bill with the Customer's name and address listed as a form of order verification. The Customer agrees to provide this information, if requested.
23. All requests for Internet Protocol Addresses ("IP Addresses") must be justified. QuickPacket will be the sole arbiter as to whether or not the justification provided by the Customer is adequate.
If you are unsure of whether any contemplated use or action is permitted, please contact QuickPacket by submitting a support ticket.
